These Terms of Use govern your access to and use of proformarealestate.ca and its pages, forms, chat tools, external links and other content (collectively, the "Website").

The Website is operated by Proforma Real Estate Team, led by Will Yohana, Sales Representative with eXp Realty, Brokerage ("Proforma," "we," "us" or "our").

By accessing or using the Website, you agree to these Terms of Use. If you do not agree, please do not use the Website.

2. General Information Only

Website content is provided for general informational and marketing purposes. It is not legal, financial, tax, mortgage, insurance, appraisal, inspection or other professional advice.

Real estate circumstances differ, and information may become outdated. You should obtain advice from appropriately qualified professionals before acting on Website information.

3. No Agency or Client Relationship

Visiting the Website, using a calculator or search feature, communicating through chat, submitting a form or receiving general information does not by itself create a client, agency, representation, fiduciary or other professional relationship with Proforma or eXp Realty, Brokerage.

Any real estate representation relationship must be established separately in accordance with applicable law and brokerage requirements.

4. Accuracy and Availability

We make reasonable efforts to provide useful and current information, but we do not warrant that Website content, property information, market data, automated responses or third-party information is complete, accurate, current or error-free.

The Website and any feature may be changed, suspended or unavailable without notice. Property availability, prices, descriptions, measurements, taxes and other details may change and must be independently verified.

5. Property Listings and External Searches

The Website does not operate an MLS®, IDX or DDF® property-listing database. It may provide links to REALTOR.ca, brokerage websites or other third-party services where visitors can search for property listings.

Listing availability, prices, descriptions, measurements, taxes and other property details are controlled by the applicable third-party service and may change without notice. Proforma does not warrant that third-party listing information is complete, current or error-free. Property information should be independently verified before being relied upon.

REALTOR.ca and other third-party services are governed by their own terms of use and privacy policies. A link is provided for convenience and does not make Proforma responsible for the operation, content, security or privacy practices of the linked service.

6. Home Evaluations

Any home-value information, comparative market discussion or response to a home-evaluation request is preliminary and provided for general information. It is not a formal appraisal, guarantee of market value or promise that a property will sell for a particular price.

An informed opinion of value may require further research, verification and an inspection or in-person visit.

7. Website Chat and Automated Responses

Website chat may use automated or artificial-intelligence-assisted technology. Responses may be generated using general information and may contain errors, omissions or outdated information.

Chat responses do not constitute professional advice, confirm property availability, create a representation relationship or bind Proforma or the brokerage. Important information must be independently confirmed directly with Proforma.

8. Appointments and Form Submissions

Submitting a form or requesting an appointment does not guarantee availability, acceptance of instructions, representation or the provision of any service. An appointment is not confirmed until confirmation is provided through the booking system or directly by Proforma.

You agree that information you submit will be accurate and that you will not impersonate another person or submit information without authority.

9. Acceptable Use

You may not:

• use the Website for unlawful, fraudulent or abusive purposes;
• attempt to gain unauthorized access to the Website or connected systems;
• interfere with Website operation or security;
• introduce malicious code or automated traffic;
• scrape, harvest or systematically collect Website or listing content;
• use Website content to create or enhance a competing listing database; or
• infringe intellectual-property, privacy or other rights.

10. Intellectual Property

Unless otherwise indicated, Website text, design, graphics, branding, photographs and other original content are owned by or licensed to Proforma, the brokerage or their respective providers and are protected by intellectual-property laws.

You may view Website content for personal, non-commercial purposes. No other right or licence is granted. Third-party names, logos and trademarks remain the property of their respective owners.

11. Third-Party Services and Links

The Website may link to or embed third-party property searches, maps, videos, calendars, social networks and other services. These are provided for convenience. We do not control and are not responsible for their availability, security, accuracy, content, policies or practices.

Your use of a third-party service is governed by that provider's terms and privacy policy.

12. Electronic Communications

If you request information or submit an inquiry, you authorize us to respond using the contact information provided.

Marketing emails and text messages will be sent only where permitted by law. You may unsubscribe from marketing communications at any time. Transactional, service-related or legally required messages may still be sent where appropriate.

13. Disclaimer of Warranties

To the fullest extent permitted by law, Proforma, eXp Realty, Brokerage, and their respective directors, officers, employees, representatives, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of data, loss of opportunity or loss of profits arising from or related to your use of, inability to use or reliance on the Website.

Nothing in these Terms limits liability where doing so is prohibited by law.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Proforma and eXp Realty, Brokerage from claims, liabilities, losses and reasonable costs arising from your unlawful use of the Website, your violation of these Terms or your infringement of another person's rights.

16. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Subject to any rights you may have under applicable consumer-protection law, disputes relating to the Website will be submitted to the courts of Ontario.

17. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Continued use of the Website after an update constitutes acceptance of the revised Terms.
